1. Introduction

Our agreement with you provides:

  • Who we are;
  • Information you will need to know before you book;
  • A step by step guide to booking your break;
  • Payment arrangements;
  • Information about arriving, staying and departing from our boutique cottages; Information we will need to know about you and your party – including any special needs;
  • Change and cancellation arrangements; and contact details.

2. Who We Are

This Is Not Here (“us”, “we”, or “our”) operates the This Is Not Here website (the “Service”) and holiday cottages and event space.

3. To Book Your Break

  • Please:
    • Read this agreement thoroughly
    • Log on to thisisnothere.co.uk or telephone our us on +44 (0) 77 90 61 53 15
    • Note that you must be over 21 to make a booking.
  • Booking more than 6 weeks ahead
    • A deposit payment of 20% of the total cost of your break is required to secure your booking. The balance to be paid 6 weeks before the start of your break. Any balance may be paid through our website using a debit or credit card as well as BACS transfer.
    • Your deposit is a non-refundable booking fee covering the administrative costs we incur in processing your reservation. We strongly advise that you have comprehensive travel insurance at the time of making your booking to cover any eventualities. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
    • Alternatively, you may pay the full cost of your break at this point.
    • Please note the pricing information contained in Section 4 and the change and cancellation arrangements in Section 10.
  • Booking less than 6 weeks ahead
    • Full payment is required at the time of making your reservation.
  • There may also be a £200 refundable damage deposit required.
  • Payment confirmation
    • Please check the details on the confirmation carefully. If any of the details are incorrect, or change, especially your address, you must inform us as soon as possible. You must also ensure that you pay any amount required in accordance with the confirmation payment schedule. If you do not, we will have the right to cancel your reservation and keep or claim your deposit (as it is a non-refundable booking fee).
  • Our agreement
    • A contract (our agreement) is formed when we receive the required payment and you have received the confirmation. If you do not receive a confirmation within 24 hours, please contact us immediately.
    • Required payment means either the required deposit or the full amount due for your break.
    • Our agreement incorporates information provided on our website, the confirmation and this agreement.
    • Our agreement with you binds you, (the person named on the confirmation), and all members of your party, including children and any day visitors. You must ensure that all members of your party are aware of and accept all of this agreement. Our agreement continues until the last member of your party has left the property, including any extension to your stay and for such time afterwards as may be necessary.
    • We will send you, an email confirmation showing the price for your break and any additional charges. It will also detail payments received and due.

4. The Price of Your Break and What it Includes

  • Our prices
    • Prices will fluctuate based on the booking platform, demand for that particular break and type of accommodation. Therefore, prices are subject to change and may go up or down. The agreed price for your break will be quoted when you make a reservation and will be shown on the confirmation.
  • This price includes:
    • Use of your accommodation for the maximum number of guests we indicate;
    • Any other amenities or services described as included in the price of your break in the information provided to you.
    • Up to 2 well behaved friendly dogs.
  • The price does not include:
    • Use of facilities and activities/produce not included within your break, for example cycle hire, leisure activities, robes and outdoor towels, private chefs, produce. Additional charges and different booking arrangements apply – separate agreements will be formed for these items.
    • Cots or highchairs or other children’s equipment for your accommodation.
    • Cot linen.
    • Additional coal, kindling and logs.
    • Electricity used through our Electric Vehicle (EV) charging points.
    • Outdoor living items at Lola Summerhouse, for example Wood Fired Oven, Logs, Firepit, Wood BBQ, Cast Iron/Metal Cooking Equipment & Utensils or Pizza Utensils.
    • Pay to view streaming services other than Netflix.
  • Additional charges
    • We welcome upto 2 dogs free of charge, if you have more than 2 dogs please discuss at the point of booking. Any booking with dogs, you must comply with the requirements set out in paragraph 8.18.
  • Tax and price promise
    • All relevant prices include VAT at the appropriate rate.
    • We have the right to increase or decrease prices in line with any change in VAT or any other dues or fees levied on your break. We will not make any such increase to the basic cost of your break within 30 days of your holiday arrival date. These provisions do not apply to any other separate charges.

5. Important Information

Where the majority of the party is under 21 or includes any person(s) who are normally closely supervised, there must be sufficient capable and responsible adults over the age of 21, in every cottage to provide adequate supervision for the party and each member of it. One such identified person must be present for the duration of the break and accept overall responsibility for the whole party. The name and contact details of this person must be the lead booking name.

If we incur costs in providing assistance or supervision to your party, we reserve the right to claim compensation from you in accordance with paragraph 8.22.

  • Special requirements and disabilities
    • We welcome guests with restricted mobility, a disability, medical or particular care requirements. We aim to ensure that our services are as accessible as reasonably possible so it is important that we are fully appraised of any needs, requirements and conditions prior to any booking being concluded. Please email us to discuss availability, suitability and any potential reasonable adjustments we can make, including any requirement for a guest to be accompanied by someone who is able to provide for any particular needs they may have over and above any reasonable adjustments we are able to make. A risk assessment may be required prior to confirming a booking or allowing participation in certain activities.
    • We rely on the information you provide to help us anticipate and satisfy your needs. We therefore require you to update us with any change in circumstances prior to and during your stay.
  • Medical assistance and clinical waste
    • Each cottage has a small First Aid kit. As such it will be necessary for a guest to be able to administer or attend to their own medical need or have someone accompany them who can do so.
    • Disposal of sharps and clinical waste should be in line with HSE & NHS guidelines and taken away with you. It must not be disposed of in the cottage or anywhere in the grounds of the accommodation.
  • Groups, organisations and institutions
    • Where a party or a booking consists of 2 or more cottages and/or is to include members from an organisation/institution/similar body or those benefiting from activities organised by third parties, for example, charities, local authorities, NHS trusts and the like, you must provide the following before we can confirm your booking;
      • The name and type of organisation/institution etc. (if applicable);
      • Any other information we may reasonably require.
    • We offer the services of a personal event planner, please call or email us to discuss.
    • In order to preserve our family environment and do not cause offence to our neigbours, we do not permit “stag/hen” parties or similar.
  • Information about your party
    • We have the right to obtain the name, date of birth, address and gender of each member of your party before confirming your booking or at any time. You (the booker) must be a member of your party unless we agree otherwise. Failure to provide us with full details of the make up of your party prior to your arrival may result in access to your cottage being delayed or denied.
    • We want to maintain a safe and secure environment for you and your family and may ask for identification on arrival. We don’t knowingly allow anyone to use or visit our cottages who is a convicted child sex offender or subject to the notification requirements of the Sexual Offences Act 2003, or subject to a Sexual Risk Order or Child Abduction Notice.
  • Security Searches
    • We reserve the right to conduct security searches as a condition of entry to protect your safety and that of other visitors. We may conduct security searches of clothing, bags and vehicles, as determined by us in our reasonable discretion, including on entry and exit of the estate.
  • Gifts, prizes or promotions
    • Should you wish to use the ‘This Is Not Here’ product as a gift, prize, part of a reward programme or other promotion you must contact us first before making any booking. We will then detail the special requirements that apply. By booking you will be deemed to have accepted our special requirements as notified to you.
    • You may not advertise, use, give or resell your break or any promotional discount or offer to do so (for profit or otherwise) or use it in connection with a competition, promotion, business and charitable or any other similar venture without our express advance written permission.
    • Please note our rights to cancel for breach of any terms in this agreement, in paragraph 10.4.

6. Before You Arrive

  • Please complete your registration detailing all members of your party before your arrival.
  • We recommend that you pre-book any activities/requests such as private chef, produce etc.
  • Please check with us before you leave home for all the latest information and any particular circumstances that apply to your break.
  • You should inform us immediately if, within 6 weeks prior to your arrival date or during your break, any member of your party has, or develops, an infectious or contagious medical condition. If so, we have the right to:
    • Refuse to accept your booking; or cancel your break; or
    • Ask any member of your party to refrain from taking part in certain activities; or
    • Ask any member of your party to leave immediately, should we, at our discretion consider it necessary to protect the health of other guests, staff or the general public.
  • You should also advise us of any other special medical circumstances, such as a member of your party being terminally Such information will be treated in strict confidence.

7. Arrival

  • Your cottage will be available from 3pm.
  • In order to help minimise our carbon footprint and to reduce traffic volumes we ask no more than 2 cars per cottage.
  • There are restrictions on the access and parking arrangements for larger vehicles, please ask us at time of booking. Caravans, campers and/or mobile homes are not permitted.

8. During Your Stay

  • Our aim is to provide a relaxed break suitable for families in a natural environment. To ensure the maximum enjoyment of your break and that of all our other guests you must comply with all of the requirements in this agreement. We draw your particular attention to the paragraphs below and to the safety and other information you will receive in your welcome pack at check in. You must also note and comply with all verbal or written guidance, especially safety guidance supplied to you by us or one of our staff, special attention should be paid to Fire, Hot Tub, Pets and Noise. You must comply with all notices.
  • Important information, guidance and updates will be included in your personalised welcome pack in your cottage.
  • Behaviour and compliance with this agreement
    • You are responsible for the behaviour of all members of your party. Behaviour should be in keeping with the family environment and should not be aggressive, excessive, noisy or disruptive, especially at night. Offensive or illegal behaviour will not be tolerated and may result in the police being involved. Offensive or aggressive behaviour or language towards our staff is not acceptable. We may ask you and/or any member of your party to leave immediately if your conduct results in police attendance or is considered by us to be inappropriate; likely to cause harm; or impair the enjoyment, comfort or safety of anyone; or is likely, in our belief, to breach any of this agreement. No refunds or compensation will be given in these circumstances and we reserve the right not to accept any future bookings from you or any member of your party.
  • Children’s supervision and parental responsibility
    • There must be at least one capable and responsible adult over the age of 21 in every cottage.
    • You are responsible for the supervision of all members or your party under the age of 21. This is particularly important in all outdoor areas where there are BBQ’s, Firepits, Hot Tubs etc.
  • Safeguarding
    • It is our policy to report any incident or allegation of concern, and assist any proper enquiries about a child staying at one of our cottages.
  • Facilities and activities
    • We offer a range of facilities and activities through third party suppliers which you may purchase separately. Whilst we facilitate booking and sometimes payment, the contract is with yourself and that third party supplier. These may be booked before your break or following your arrival. All facilities and activities (including those contained within the price of your break) are subject to availability. We operate a “first come-first served” policy so we cannot guarantee that you will be able to book a particular facility/activity/produce for a specific time or at all.
    • Activities that take place outdoors are provided subject to appropriate weather conditions prevailing at the time the activity is to take place. Additional facilities may be available from time-to-time and will be advertised.
    • We will not pay compensation where facilities/activities are unavailable or fully booked except where paragraph 10.4 applies.
    • The general activity conditions, this agreement, our Safety Information and any special conditions we make known to you apply to any facilities and activities you book and must be complied with. These will be detailed when booking and/or before/during the activity.
    • You must ensure that any activity or facility selected by any member of your party is suitable for those who are taking part.
    • You must arrange supervision for children under 8 taking part in activities or using facilities.
    • Towels provided are for use in the cottage only, if you require towels for the hot tub or days out, please either hire these from us or bring your own.
  • Security of your property – We draw your special attention to the following:
    • Your belongings, vehicles and contents are left at your own risk. Your personal belongings are your responsibility during your break with us. Vehicles parked on our property are subject to CCTV surveillance, but you must lock your vehicle securely and remove all valuable items on parking.
    • The police have notified us that personal cycles are particularly vulnerable in the nationwide problem of cycle theft. If you choose to bring your own cycle we strongly recommend that you follow good security advice, lock etc and obtain adequate insurance for it. The cycle store can be used but is used at your own risk.
    • There is a safe in Jenson Cottage, we are happy to store items at your risk in one of our safes. Any items must be in a sealed bag.
    • Appropriate insurance is strongly recommended
    • We accept no liability for any accident, loss or damage to your property unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible
    • We will offer reasonable help to assist you in tracing lost items, however we can only keep lost items for 28 days. It is your responsibility to arrange collection of lost property, we do not post/courier items you leave.
    • Please lock the doors and close all windows when you leave the property unoccupied.
  • Produce – Food, beverages and other supplies are offered/provided subject to availability and are not guaranteed. These are provided by third parties and separate contracts will be made with each of them, when making any request it is your responsibility to inform us and our suppliers of any intolerances you or anyone in your party has.
  • Environment – Please keep to prepared roads, paths and tracks at all times and treat all property and facilities carefully and appropriately.
  • Accommodation
    • You must use your accommodation and its contents with care and leave it in a clean and tidy condition on departure. An accommodation inventory is available in your personalised welcome pack that is provided in your accommodation on arrival. We reserve the right to charge you for any extra cleaning, missing items or damage.
    • We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, maintenance work or housekeeping. Your occupation is not exclusive.
    • The members of your party and the allocation of guests in each accommodation unit must remain the same for the whole of your stay.
    • The maximum number of guests in each accommodation type as stated on your booking must not be exceeded. If it is, we may move those additional persons to another accommodation unit and will charge you or them the appropriate full charge for the additional accommodation, from the date your party arrived for the break.
  • Wireless facilities
    • Wireless internet access, where available, is not guaranteed and is provided subject to third party terms and conditions. The facility is not subject to any particular security, and only has limited filtering measures and requires continuous parental supervision when used by children.
    • We reserve the right to disclose your name and address to our internet service provider or police if we discover that you or a member of your party illegally downloaded content from the internet or otherwise engaged in unlawful activity whilst using this facility.
  • Improvements and maintenance – As we continually maintain and improve our facilities you may find that:
  • New facilities are on offer;
  • Listed facilities are temporarily closed for maintenance and/or improvement;
  • Some facilities and/or accommodation types have been altered, replaced or closed;
  • There is development or refurbishment work going on in certain areas of the estate.
  • Whilst we take steps to reduce the impact of such works, you may experience noise and visual disturbance;
  • Maintenance work or housekeeping tasks are undertaken in and around your accommodation during your stay, although in such circumstances we try to minimise any inconvenience;
  • Different equipment is provided to that described in our brochure or other communications
  • Hot tubs should not be used before 10 am as a daily water quality sample needs to be taken and in some cases chemicals added to balance the water.
  • Safety

You are required to follow any safety advice provided to you. Please note in particular:

  • Safety advice in your welcome pack.
  • Appliance instructions in your welcome pack.
  • Hot Tub rules in your welcome pack and on the wall near each hot tub. The hot tub water quality is sampled daily, if the rules are not followed and the water quality is out of parameter the hot tub may be taken out of service. To avoid this please follow the hot tub rules.
  • Instructions for all appliances including the SMART TV lift in Jenson cottage
  • Gas BBQ
  • Fire Pits
  • Fires
  • Take particular care not to do anything which might cause a fire – dispose of cigarettes responsibly and DO NOT flick them on the floor. Smoking is not permitted inside any cottage or within 2 meters of it.
  • Fireworks may not be brought onto or used at our villages.
  • When not at the cottage, please ensure you switch off lights and electrical appliances.
  • Candles are not permitted in the cottages.
  • Driving on the estate and parking
    • In your welcome pack you will be provided with a unique 4 digit code for the duration of your stay. This code is used to open the main gates when returning to the estate. When leaving the gates will automatically open, please ensure you do not drive through the gates unless they are fully opened.
    • At all times please give way to pedestrians, dogs and cyclists, keep to the left and within the 10 mph speed limit.
    • Please use great care when driving. Sleepers, boulders, logs and posts are placed to prevent damage to the roadsides and unauthorised parking. No liability is accepted for any damage caused by these markers unless due to our negligence.
    • All vehicles should be parked up close to the cottage you are in and leave access for other vehicles to get past. Vehicular access is required for emergency services and our own vehicles.
  • Legislation and licensed premises
    • We shall not serve or sell alcohol to anyone who is, or appears to be, under the age of 18 (and cannot prove they are over 18), or whom we, in our sole discretion, consider to have been drinking excessively.
    • We will accept a photo driving licence, a passport, Military ID Card or a proof of age scheme which carries the PASS logo hologram.
  • Smoking policy
    • Smoking (including e-cigarettes and vaping) is not permitted in any buildings (including accommodation)
    • Smoking (including e-cigarettes and vaping) is only permitted 2 meters or more from any building, patio furniture or hot tub.
  • Natural inhabitants – Please note and remember that this is the natural habitat of a variety of native creatures such as snakes, insects, spiders, rodents and ticks.
  • Dogs/Pets
    • We do not accept any dogs listed under the Dangerous Dogs Act.

You must ensure that:

  • As a minimum, each dog has a current annual vaccination for distemper, canine hepatitis, leptospirosis and parvo virus; Each dog is properly supervised, is not dangerous and does not cause a nuisance or threat to anyone;
  • When our staff need to visit your accommodation (eg. if you have requested a maintenance engineer) you take your dog(s) out or keep them in a different room while these visits take place and comply with any specific instructions provided to you.
  • If we, in our sole and reasonable discretion, consider your dog to be dangerous or to be causing a nuisance, harm or threat to anyone, or to be likely to do so, we may ask you to remove it (without refund or compensation) or have it removed to kennels at your expense. No other pets are permitted without prior consent.
  • Day visitors are not permitted to bring dogs or any other pets.
  • Dogs or other animals (by prior consent) must not be allowed on beds or furniture and must never be left alone in the cottage.
  • Dog/pet fouling must be cleared up immediately and placed in the Green bins near the main gates.
  • Dangerous items

No shotgun, knife, firearm, air weapon, catapult, drone, archery equipment, fireworks (including sparklers), illegal substances or similar item may be brought onto the estate under any circumstances by you or anyone in your party.

  • Noise

Whilst the village is small and only has 60 families living here, unusually in these times there are still 7 working farms and as such is very much a farming community (Arable, Sheep, Cattle and Pigs although no Dairy). This is fabulous in terms of encompassing Yorkshire Farming Life, however it does mean you will experience regular movement of agricultural machinery in and around the village. In addition, it is not unusual for Military and other aircraft to fly over our village. You may experience noise from such activities from time-to-time. This is beyond our control.

Equally we ask you to respect the neighbouring properties and keep noise to a minimum.

  • Photography
    • Only non-intrusive photography of your own party and friends is permitted. You may not carry out photography for commercial purposes, publication or similar purposes in any part of the estate.
    • We regularly take photographs and videos for promotional and training purposes and we occasionally receive requests from TV or other companies to film/photograph on the villages. Please be aware that filming may be in progress during your break. Should you not wish to appear in any such material please notify us on or before your arrival.
  • Compensation payable by you

By booking you agree that we have the right either during or after your stay to recover from you, whether via the credit or debit card used to pay for the break or otherwise, the costs of:

  • Any property or accommodation damage, and/or
  • Any compensation we may pay to others, and/or
  • Any other costs, fees or levies which we may incur, resulting from your or any member of your party action or inaction and from any breach of this agreement

9. Departure

  • You must vacate your accommodation and return any hired items by 10am at the latest on your day of departure.
  • Please return your key to us at the main country house/or in the lockbox as you leave, but in either event by 10am.
  • Damage Deposit Damage deposit – In making a booking you accept responsibility for any theft, breakage or damage caused by you, pets or any member of your party and agree to indemnify us in full for any loss that we may incur as a result. A security deposit of £200 is required and will be returned within 3 days of the end of your holiday, less the cost of damage/breakages.
  • Damages and breakages – please treat the facilities & accommodation with due care so that other guests may continue to enjoy them. If you notice something is missing or damaged in your accommodation, please let us know immediately so that we can take the appropriate action. If there has been any damage or breakages during your stay, we would be grateful if you could report them promptly, especially before check-out. The accommodation will be inspected at the end of the holiday & you may be charged for any loss or damage.

10. Changing or Cancelling Your Booking

  • Changing your booking
    • You may change your booking with us for any reason provided the change is made 6 weeks or more before your arrival date. Each change is subject to availability and an amendment charge to cover our administration costs.
    • You may only change your arrival date once and you must select your new arrival date within 8 weeks of requesting the change, otherwise the change will be treated as a cancellation and a fee will apply (see paragraph 10.3).
    • Please note that any change of date or accommodation will be likely to involve a change in price of your break and an amendment charge being payable. The price payable is the greater of:
  1. i) your original break cost; or
  2. ii) the price for your revised break change which applies at the time of your change. No difference will be refunded except where a change of date results in a lower price.
  • Prevented from taking your break

If you are prevented from taking your break, please contact us at the earliest opportunity. We will do our best to assist. You may not, under any circumstances, transfer your booking to anyone without our consent. We will not consent to a transfer where the person or party concerned does not meet our requirements.

  • Cancellation by you
    • You may cancel your break at any time. However, a fee will be charged as follows:

More than 6 weeks from date of arrival = Full deposit

More than 3 weeks but not more than 6 weeks from date of arrival = 50% of cost of your break.

3 weeks or less from date of arrival = 100% of cost of your break

  • Please note that separate arrangements apply to cancellation of activities or produce, details of which will be provided at the time of booking any activities or produce.
  • To cancel your break, please telephone or email us.
  • Cancellation and changes by us
    • We have the right, at our sole discretion, to refuse to confirm any reservation. Where we have indicated that we will not accept a booking from you or accept your presence on our estate, we reserve the right at our sole discretion to cancel any booking you may have made or refuse to allow you to enter the estate or to ask you to leave our premises. If we do so (subject to the provisions of the paragraph below) we will refund any payment made but will not pay any compensation.
    • We have the right to cancel your booking, or to instruct you or your party to leave the estate immediately, without compensation or refund, should you or any of your party not comply with this agreement, particularly terms relating to behaviour and conduct.
  • Things beyond our control
    • We cannot take responsibility or pay compensation if we cancel or change your booking in any way because of events beyond our control. Neither can we accept any liability for any injury, loss or damage you suffer because of events beyond our control. Events beyond our control include, but are not limited to: fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, epidemics and pandemics, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and unavoidable technical problems.
    • In the event of adverse weather, your booking will only be refunded if we close the estate. If you cannot travel to the estate due to adverse weather, we will do our best to move your booking to an alternative date, but refunds will not be provided. If your new break is more expensive, you will be required to pay any additional cost.
    • In exceptional circumstances, we may need to cancel your booking. If this happens we will advise you as soon as possible and offer one of the below options.

A replacement break to the same value as the one you booked. If your new break is more expensive, you will be required to pay any additional cost. If your new break is less expensive, we will refund the difference.

A full refund. If we issue you with a refund, we will return your money in the same way you made your original payment.

  • In all cases, except personal injury or death, our liability to you for the total of all claims arising out of your break with us is limited to the cost of your booking less any amendment or separate charges.
  • Refunds

Credit or debit card payments will be refunded via the same card number, less any non-refundable deposit and any other non-refundable amounts. Cheque/BACS transfer refunds will be made to the person named on the confirmation.

11.Important Information

  • Your bookings and your contract is with This Is Not Here of Main Street, Skirpenbeck, York, YO41 1HF.
  • Accommodation and surroundings at our estate is currently being upgraded as part of a rolling programme. This means that we accept your preference request for a particular location on the basis that it is subject to availability at the time of your stay. Should the chosen accommodation not be available at the time of your stay we will act reasonably in offering you either the nearest available equivalent or an alternative option which may mean a higher or lower price is payable.
  • All images (including CCTV) and personal information we collect and hold about you and members of your party will be used in accordance with our privacy policy, available on our website.
  • Whilst we do our best to ensure that our website is accurate, all images on our website and in other promotional material, are for illustrative purposes only. Facilities at the estate vary and not all accommodation is identical to the images on the website. So please read accommodation specific information carefully.
  • This agreement and any dispute between us will be governed by and construed in accordance with the laws of England. You agree to submit to the exclusive jurisdiction of the Courts of England over any matter arising out of our agreement or your visit. We must both act reasonably in selecting or agreeing any forum for dispute resolution.
  • Your stay will not give rise to any tenancy agreement between us.
  • Should any part of our agreement be deemed by law to be void, the remainder of this agreement will, if capable, continue in full force and effect. The headings in this agreement are included for convenience only and shall not affect its interpretation or construction.

12. Can We Help

Please note that we are not responsible for any matter of which you were aware and which you did not bring to our attention during your break.

  • Any reported matter which has not been resolved during your break should be advised in writing to the Partners via email within 28 days of the end of your break. In such cases, we will only correspond with the person named on the booking. We will not enter into further correspondence on any matter resolved during your break and accepted as such by you.
